အလကထ ရ နစ ဆကသယ ဆ ငရက ရ ဥပ ဒက ပငဆငသည ဥ ​ ပ ဒ ပဌ န Legislation amending the Electronic Transactions Law​1 ပည ထ ငစသမတ မနမ ငင တ State Administrative Council ငင တ စမအပခ ပ ရ က ငစ ငင တ စမအပခ ပ ရ က ငစ ဥပ ဒအမတ(၇/၂၀၂၁) အလကထ ရ နစဆကသယ ဆ ငရက ရ ဥပ ဒက ပငဆငသည ဥပ ဒ ၁၃၈၂ခ စ၊တပတ လဆန ၄ရက ၂၀၂၁ခ စ၊ ဖ ဖ ဝ ရလ ၁၅ရက The Republic of the Union of Myanmar State Administrative Council Law No. (7/2021) Law Amending the Electronic Transactions Law 4th day of the first lunar month, 1382 February 15, 2021 ၁။ ငင တ စမအပခ ပ ရ က ငစသည ပည ထ ငစသမတ မနမ ငင တ ဖ စည ပအ ခခဥပ ဒပဒမ၄၁၉အရ ဤဥပ ဒက ပဌ န လကသည။ 1. The State Administrative Council enacts this Law in accordance with Article 419 of the Constitution of the Republic of the Union of Myanmar. ၂။ဤဥပ ဒက အလကထ ရ နစဆကသယ ဆ ငရက ရ ဥပ ဒက ပငဆငသည ဥပ ဒဟ ခ တင စရမည။ 2. This Law shall be called the Law Amending the Electronic Transactions Law. ၃။အလကထ ရ နစ ဆကသယ ဆ ငရက ရ ဥပ ဒပဒမ ၂ပဒမခ(က)က အ ကပ အတင အစ ထ ရမည။ 3. Article 2 subsection (a) of the Electronic Transactions Law shall be substituted as follows: (က)သတင အခ ကအလကဆသညမ အခ ကအလက (Data)၊ မရင စ ( Text)၊ ပရပသဏ န(Image )၊ အသ( Voice)၊ဗဒယ (Video )၊ သ က်တ (Code )၊ ဆ ဖဝ ( Software)၊အပလ က ရင ( Application) င အခ ကအလကအစအ ဝ ( Database)တကဆလသည။ (A) “Information” means data, text, images, audio, video, Code Software, Application, and Database ၄။အလကထ ရ နစဆကသယ ဆ ငရက ရ ဥပ ဒ ပဒမ ၂ 4. Article 2 of the Electronic Transactions Law, s​ubsection (k) will be followed by subsection (l), subsection (m), subsection (n), subsection (o), subsection (p), subsection (q) and subsection (r) shall be supplemented as follows: ပဒမခ(ဋ)၏ န ကတင ပဒမခ (ဌ)၊ပဒမခ(ဍ)၊ပဒမခ(ဎ)၊ ပဒမခ(ဏ)၊ပဒမခ(တ)၊ပဒမခ(ထ) င ပဒမခ(ဒ)တအ ဖစ အ ကပ အတင ဖညစကရမည။ (ဌ) ကယ ရ ဆငရ အခ ကအလကဆသညမ လတစဦ တစ ယ က င ဆကသဘသည မညသမညဝ အ ဖစ အတည ပ ပ သ သမဟတ အတည ပ င သ မညသည အခ ကအလကကမဆ ဆသည။ (l) “Personal information” means any information which has been verified or verified as a person associated with a person. (ဍ)ကယ ရ ဆငရ အခ ကအလကက စမထန သမ ရနတ ဝနရသ ဆသညမ တညဆဥပ ဒ တစရပရပအရ ဖစ စ၊ဤဥပ ဒပ ပဌ န ခ ကအရ ဖစ စ၊ ကယ ရ ဆငရ အခ ကအလကက က ကခ ခင ၊စ ဆ င သမ ဆည ခင င အသ ပ ခင တအ ဆ ငရက ငသည အခငအ ရ အ ဏ ရ သ အစ ရဌ န၊အဖ အစည တခခက ဖစ စ တ ဝန ပ အပ ခင ခရ သ ပဂ လ င ယင ၏ဝနထမ မ က ဆလသည။ (m) “Person responsible for the management of personal information” means the person under any existing law or the provisions of this Law; It means the person and its staff assigned by a government department or organization that has the authority to collect, store, and use personal information. 1 www.FreeExpressionMyanmar.org​ – w ​ ww.facebook.com/FreeExpressionMyanmar​ - c​ oordinator@FreeExpressionMyanmar.org
