အသေရဖ်က္ျခင္းႏွင့္ လြတ္လပ္စြာထုတ္ေဖာ္ေရးသားေျပာဆိုျခင္း - Defamation and freedom of expression အသေရဖ်က္ျ ခင္းဆိုင္ရာဥပေဒ သို႔မဟုတ္ ျပဌာန္းခ်က္၏ ရည္ရြယ္ ခ်က္မွာ လူပုဂၢိဳလ္တ စ္ဦးတစ္ေယာက္၏ “ဂုဏ္သိကၡာ ” အခြင့္အေရး ကို ကာကြယ္ရန္ျ ဖစ္သ ည္။ ၂ လူတ စ္ဦးတစ္ေယာက္၏ ဂုဏ္သိကၡာ ဆိုသည္မွာ လူ႕အဖြဲ႕အစည္းအတြင္းရွိ သူ၏ ရပ္တ ည္ခ်က္ျ ဖစ္သ ည္။ လူတစ္ဦးတစ္ေယာက္၏ ဂုဏ္သိကၡာအခြင့္အေရးကို ႏိုင္ငံတကာ ဥပေဒ ေအာက္တင ြ ္ အာမခံခ်က္ေပးထားသည္။ “အပိဒ ု ္ ၁၇ : မည္သတ ူ စ္ဥးီ တစ္ေယာက္မ်ွ သူ၏ဂုဏသ ္ က ိ ၡာ၊ ေက်ာ္ၾကားမႈအေပၚ ဥပေဒႏွင့မ ္ ညီေသာ တိက ု ခ ္ က ို မ ္ ႈ မခံေစရ။” ၃ The purpose of a defamation law or provision is to protect an individual's right to a “reputation”.2A person's reputation is their standing within society. The right to reputation is guaranteed under international law: "Article 17: No one shall be subjected to […] unlawful attacks on his honour and reputation."3 - International Covenant on Civil and Political Rights (1966) - အရပ္ဖက္ႏင ွ ့ ္ ႏိင ု င ္ ေ ံ ရးအခြင့အ ္ ေရးမ်ားဆိင ု ရ ္ ာ ႏိင ု င ္ တ ံ ကာသေဘာတူညခ ီ ်က္(၁၉၆၆) တစ္စံုတစ္ရာေသာ အခြင့္အ ေရးရွိလွ်င္ ကုစားမည့္ နည္းလမ္းလည္း ရွိရေပမည္။၄ “အသေရဖ်က္ျ ခင္း” ဆိုသ ည္မွာ လူတ စ္ဦး ၏ ဂုဏ္ သိကၡာ ကို ပ်က္စီးေစေသာ မွားယြင္းသည္ ့အဆိုတ စ္ရပ္ကို ေဖၚျပ ရာတြင္သံုးေသာ ေဝါဟာရျဖစ္ျ ပီး ကုစားမည့္နည္းလမ္းလည္း လို အပ္ေပသည္။၅ မည္သို႔ပင္ဆိုေစကာမူ ေအာက္ပါအခ်က္မ်ားကို အ သိအမွတ္ျ ပဳ နားလည္ထားရန္မွာလည္း အေရးၾကီးေပသည္။ • တစ္စံုတစ္ဦး၏ဂုဏ္သက ိ ၡာ ကို ပ်က္ယြင္းေစျခင္းသည္ တစ္ခါ တစ္ရံ က်ိဳးေၾကာင္းညီညြတ္သည္။ ဥပမာ- တစ္စံုတစ္ဦး၏ မွာ း ယြင္းေသာ လုပ္ရပ္ကို သိျ မင္လာေအာင္ တင္ျပျခင္း။ • အခ်ိဳ႕ေသာသူမ်ားသည္ ပင္ကိုယ္က နာမည္ဆိုး ထြက္ေနသူမ်ား ျဖစ္ၾကသည္။ ဥပမာ- အက်င့္ပ်က္ျခစားေနေသာ အစိုးရ အရာ ရွိၾကီးတစ္ဦးကို အသေရဖ်က္ရန္ ခက္ခဲသ ည္။ အေၾကာင္းမွာ သူ႔အေနျဖင့္ ယခင္က တည္းက ဂုဏ္သက ိ ၡာ က်ဆင္းျပီး ျဖစ္ေန ေသာေၾကာင့္ ျဖစ္သ ည္။ • အကယ္၍ ဆိုးဝါးေသာထိခိုက္နစ္နာမႈျ ဖစ္ေပၚေစမွသာလွ် င္ လူ တစ္ဦး၏ ဂုဏ္သိကၡာကို ပ်က္ယြင္းေစျခင္းသည္ အသေရဖ်က္ မႈ ေျမာက္ေပမည္။ဥပမာ - ထိုသူ၏ စီးပြားေရးလုပ္ငန္းကို ထိ ခိုက္မႈရွိျ ခင္း၊လူ႕အသိုင္းအဝန္းမွ ဝိုင္းပါယ္ခံရျခင္း။ အမ်ိဳးသားလႊတ္ေတာ္၊ဥပေဒၾကမး္ေကာ္မတီဥကၠဌ က အသေရဖ်က္ မႈဆိုသ ည္ကို မွန္ကန္စြာ ေဖၚျပေျပာဆိုခဲ့သည္။ အြနလ ္ င ို း္ တြင္ ရည္ရြယခ ္ ်က္ရွရ ိ ျွိ ဖင့္ တစ္စုတ ံ စ္ရာ ေရးသား Where there is a right there is a remedy.4"Defamation" is the word used to describe false statements of fact that damage a person's reputation and require remedy.5However, it is important to recognise that: • Damaging someone’s reputation is often justified. For example, raising awareness of someone's wrongdoing. • Some people already have bad reputations. For example, it is difficult to defame a corrupt governmental official because their reputation is already bad. • Damaging a person's reputation is only defamation if it causes serious harm. For example, by affecting their business or leading to social exclusion.
