Reasonable belief of truth Your defence strategy may be to claim the defence of reasonable belief of truth if you had reasonable grounds to believe what you were saying was true. Some international courts have extended the defence of truth to cover false statements that a speaker reasonably believed to have been true at the time. In such cases, although the listener may have committed a crime following the falsehood, the speaker did not intentionally disseminate the falsehood. Example: Facebook user YaTi posted that the military was shooting non-violent protesters after reading it in reliable media. YaTi’s defence lawyer argued that although the shooting did not happen, YaTi had reasonable grounds to believe that it did and so should not be held responsible. Impossibility Your defence strategy may be to claim the defence of impossibility if there was no chance of the incited crime taking place. One type is impossibility due to ineptitude, meaning that you had inadequate means to commit the crime of incitement. For example, you had no means to disseminate your expression to your target listener. Another type is physical impossibility, where you cannot achieve the crime. Example: Activist Nan May incited a friend to kill a person, but that person was already dead. Nan May’s defence lawyer argued that it would be impossible to kill an already dead person, and therefore incitement could not have been committed.
